These Terms of Service ("Terms") govern your use of the Nexhelm platform ("Platform"), which includes AI model development, data processing, machine learning training, API services, and related AI tools ("Service"). By accessing or using the Platform and Service, you agree to be bound by these Terms.
By using our Platform and Service, you accept these Terms in full. If you do not agree with any part of these Terms, you must not use our Platform or Service.
Nexhelm AI provides a platform that enables client-facing professionals to grow their client base by automating meeting prep, live in-meeting support, personalized follow-ups, CRM updates, and surfacing upsell opportunities and churn risks - all in one unified platform.
You must be at least 18 years old to use the Platform. You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not use the Platform in any way that could damage, disable, overburden, or impair the Platform or interfere with any other party's use of the Service.
To access certain features of the Platform, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
By using the Platform, you agree to the collection, storage, and processing of data as described in our Privacy Policy. This includes the processing of training data, model inputs and outputs, usage analytics, and the storage of any related data for service improvement and model training purposes.
All content and materials available on the Platform and Service, including but not limited to the AI models, software code, algorithms, text, graphics, and logos, are the intellectual property of the Company and are protected by applicable copyright and trademark law. You agree not to reproduce, distribute, or create derivative works based on the content and materials without our prior written consent.
Certain features of the Platform may require payment. You agree to provide accurate and complete payment information and to promptly update your account with any changes. All fees are non-refundable unless otherwise stated. We reserve the right to change our pricing at any time.
You agree not to use the Platform to:
• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Collect or store personal data about other users without their consent.
• Engage in any activity that interferes with or disrupts the Service.
You acknowledge that the AI models, data processing pipelines, and machine learning tools are integral components of the Service. You agree not to misuse these components, including but not limited to attempting to reverse engineer, tamper with, or otherwise exploit the AI models or platform functionalities in unauthorized ways.
While our platform is designed to help financial advisors, you remain responsible for ensuring your use of our service complies with all applicable financial regulations, including but not limited to those administered by the SEC, FINRA, and other regulatory bodies. Our service does not replace the need for proper compliance with regulatory requirements.
We strive to provide reliable and high-quality service; however, we do not guarantee that the Platform will be error-free or uninterrupted. The Service may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications.
We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Platform, us, or third parties, or for any other reason.
To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Platform or Service.
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. We encourage you to review these Terms periodically. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of United States, without regard to its conflict of law principles.
